VOLUSIA COUNTY, FL. State inspectors cited a Daytona Beach sushi restaurant with 9 high-severity violations in a single visit last week, the highest count among 88 facilities inspected across Volusia County between September 30 and October 6, 2026.
Sumo at 1500 Beville Road drew citations for food sourced from unapproved or unknown suppliers, no employee health policy, an employee not reporting illness symptoms, inadequate handwashing facilities, improper handwashing technique, food contact surfaces that were not properly cleaned or sanitized, time as a public health control used incorrectly, and no person in charge present or performing duties when the inspector arrived. That is nine distinct high-severity failures in one inspection.
Twelve of the 88 facilities inspected this week carried two or more high-severity violations.
The Violations
Four facilities tied at eight high-severity violations each: Nice N Easy Oyster Bar and Grill at 2109 N Volusia Avenue in Orange City, Senorita Mexican Kitchen and Tequila Bar at 114 S Beach Street in Daytona Beach, Bagel Barn Cafe and Deli at 103 N Ridgewood Avenue in Edgewater, Lan Lamoon Authentic Thai Bistro at 2900 S Nova Road in South Daytona, Dino's Bar and Grill at 145 Orange Avenue in Daytona Beach, Sushi King at 240 N Nova Road in Daytona Beach, and 5th Element India Kitchen at 1448 W International Speedway Boulevard in Daytona Beach.
Nice N Easy Oyster Bar and Grill was cited for failing to follow parasite destruction procedures, a violation that applies directly to the raw and lightly cooked shellfish the restaurant serves. The same inspection found food not cooked to required minimum temperatures and no allergen awareness demonstrated by staff.
Senorita Mexican Kitchen was cited for food contaminated by chemical, physical, or biological hazards, alongside food from unapproved sources and improperly stored toxic chemicals. An inspector also noted no consumer advisory for raw or undercooked foods and no person in charge present.
Bagel Barn Cafe and Deli carried citations for food not cooked to required minimum temperatures, time as a public health control used incorrectly, and inadequate handwashing facilities, in addition to the management and illness-reporting failures it shared with several other facilities this week.
Dino's Bar and Grill drew a citation for inadequate shell stock identification records, meaning inspectors could not verify where the shellfish on hand had originated. The same inspection found food in poor condition, mislabeled, or adulterated, and no allergen awareness from staff.
Sushi King was also cited for inadequate shell stock identification records alongside food from unapproved sources, and inspectors noted time as a public health control was not properly used, meaning raw fish may have sat in the temperature danger zone without proper tracking.
NY Korean BBQ and Chicken at 2225 S Ridgewood Avenue in South Daytona drew seven high-severity violations, including food not cooked to required minimum temperatures and an intermediate citation for improper sewage or wastewater disposal.
Cracked Egg at 3280 South Atlantic Avenue in Daytona Beach also carried seven high-severity violations. Inspectors cited two separate toxic substance violations: chemicals improperly stored or labeled, and toxic substances improperly identified, stored, or used. An intermediate citation noted single-use items being reused.
Grille at 1000 Wayne Avenue in New Smyrna Beach had two high-severity violations, but both were acute: no approved potable water supply and toxic chemicals improperly stored or labeled. A facility operating without a verified potable water source cannot safely wash produce, prepare food, or clean equipment.
Yuki Sushi Hibachi at 1964 State Road 44 in New Smyrna Beach drew two high-severity violations: an employee not reporting illness symptoms and time as a public health control not properly used.
What These Violations Mean
The illness-reporting failures documented at Sumo, Nice N Easy, Senorita, Bagel Barn, Lan Lamoon, Dino's, Sushi King, 5th Element, NY Korean BBQ, Cracked Egg, and Yuki Sushi Hibachi this week all carry the same underlying risk. When a food worker comes in sick and no policy exists to stop them, the virus reaches every plate they touch. Norovirus, the most common cause of foodborne illness outbreaks in restaurant settings, is transmissible with a dose of fewer than 20 viral particles. It does not require a lapse in temperature control. It only requires a sick worker and no policy to send them home.
The food-from-unapproved-sources citations at Sumo, Senorita, Sushi King, and 5th Element India Kitchen describe a different but equally serious problem. When food enters a restaurant outside licensed and inspected supply chains, there is no paper trail. If a customer gets sick, investigators cannot trace the product back to its origin, cannot issue a recall, and cannot identify other restaurants or stores that received the same batch.
The parasite destruction failure at Nice N Easy Oyster Bar and Grill is specific to raw and lightly cooked seafood. Parasites including Anisakis in fish and Trichinella in pork are killed by freezing to required temperatures for required durations. A restaurant that skips or improperly documents this step serves food in which parasites may still be alive.
The potable water violation at Grille in New Smyrna Beach touches every operation in the kitchen simultaneously. Water used to rinse produce, fill ice machines, run the dish sanitizer, and wash hands must come from an approved, tested supply. Without it, none of those processes can be considered safe.
The Longer Record
The data does not include prior inspection counts for the facilities featured this week, which limits what can be said about their individual histories. What the inspection records do show is a concentration of serious violations in facilities that serve raw or lightly cooked proteins: two sushi restaurants, an oyster bar, a Korean barbecue restaurant, and an Indian kitchen all appeared among the week's twelve worst performers.
The overlap in violation categories across facilities is notable. Nine of the twelve worst performers this week were cited for food contact surfaces not properly cleaned or sanitized. Ten were cited for employees not reporting illness symptoms. Seven carried citations for no consumer advisory covering raw or undercooked foods.
That last figure is particularly relevant for the county's seafood and sushi establishments. A consumer advisory is a written notice on the menu warning that consuming raw or undercooked proteins carries risk, specifically for elderly diners, pregnant women, young children, and people with compromised immune systems. Dino's Bar and Grill, Sushi King, Nice N Easy Oyster Bar, Senorita Mexican Kitchen, Bagel Barn, Lan Lamoon, NY Korean BBQ, Cracked Egg, and 5th Element India Kitchen were all cited for its absence this week.
Dino's Bar and Grill carried the highest combined violation count of any facility this week: eight high-severity and five intermediate, for a total of thirteen. Its intermediate citations are not listed in detail in the inspection data, but the high-severity findings alone included shellfish traceability failures, food in poor condition, allergen awareness gaps, and improperly stored chemicals.
