VOLUSIA COUNTY, FL. Two restaurants on opposite ends of Volusia County each accumulated 9 high-severity violations during the week of September 29, and one of them was sourcing food from suppliers that bypassed federal safety inspections entirely.
State inspectors logged 96 inspections across 82 facilities during the week. Twelve of those facilities carried two or more high-severity violations. The two worst performers tied at 9 high-severity citations apiece, a count that placed them at the top of a county-wide pattern dominated by illness policy failures, unclean food contact surfaces, and improperly stored chemicals.
The Worst of the Week
Sumo at 1500 Beville Road in Daytona Beach drew 9 high-severity and 2 intermediate violations. The citations included food from an unapproved or unknown source, no employee health policy, an employee not reporting illness symptoms, inadequate handwashing facilities, improper handwashing technique, improperly cleaned food contact surfaces, and the failure to properly use time as a public health control. No person in charge was present or performing duties during the inspection.
Grille at 1000 Wayne Avenue in New Smyrna Beach matched that high-severity count with no intermediate violations alongside it. Inspectors cited the absence of a person in charge, no employee health policy, an employee not reporting illness symptoms, improper handwashing technique, food contact surfaces not properly cleaned, no consumer advisory for raw or undercooked foods, toxic chemicals improperly stored or labeled, and no allergen awareness demonstrated.
Senorita Mexican Kitchen and Tequila Bar at 114 S Beach Street in Daytona Beach followed with 8 high-severity and 3 intermediate violations. Inspectors documented food contaminated by chemical, physical, or biological hazards alongside food from an unapproved source, improperly stored chemicals, no consumer advisory, and no person in charge on premises.
Sushi King at 240 N Nova Road in Daytona Beach also recorded 8 high-severity violations, including inadequate shell stock identification records, food from an unapproved source, improperly stored chemicals, no consumer advisory, and the failure to properly use time as a public health control.
Lan Lamoon Authentic Thai Bistro at 2900 S Nova Road in South Daytona drew 8 high-severity citations, among them food in poor condition or adulterated, no allergen awareness demonstrated, no consumer advisory for raw or undercooked foods, and toxic chemicals stored improperly.
Bagel Barn Cafe and Deli at 103 N Ridgewood Avenue in Edgewater accumulated 8 high-severity and 3 intermediate violations. Inspectors found food not cooked to required minimum temperature, inadequate handwashing facilities, no consumer advisory, improperly stored chemicals, and no person in charge.
Dino's Bar and Grill at 145 Orange Avenue in Daytona Beach recorded 8 high-severity and 5 intermediate violations, the highest combined total of any facility this week. Citations included inadequate shell stock identification, food in poor condition or adulterated, no allergen awareness, no consumer advisory, and improperly stored chemicals.
Wild Ginger at 1115 Cornerstone Boulevard in Daytona Beach drew 8 high-severity violations with zero intermediate citations. Inspectors documented food from an unapproved source, inadequate shell stock records, food not cooked to the required minimum temperature, improper time-as-public-health-control use, and improperly stored chemicals.
Nice N Easy Oyster Bar and Grill at 2109 N Volusia Avenue in Orange City recorded 8 high-severity violations including a citation that appeared at no other facility this week: parasite destruction procedures not followed. The restaurant also lacked a person in charge and had no allergen awareness on record.
NY Korean BBQ and Chicken at 2225 S Ridgewood Avenue in South Daytona drew 7 high-severity violations and an intermediate citation for improper sewage or wastewater disposal, one of only two facilities this week flagged for that condition.
New Peking at 2783 Elkcam Boulevard in Deltona also recorded 7 high-severity violations alongside an improper sewage disposal intermediate citation. The facility's high-severity list included inadequate shell stock identification, no consumer advisory, no allergen awareness, improperly stored chemicals, and failure to properly use time as a public health control.
Yuki Sushi Hibachi at 1964 State Road 44 in New Smyrna Beach rounded out the list with 2 high-severity violations, both serious: an employee not reporting illness symptoms and the improper use of time as a public health control.
What These Violations Mean
The single most common high-severity violation this week was food contact surfaces not properly cleaned or sanitized, cited at nine of the twelve facilities. Cutting boards, prep tables, and utensils that are not adequately cleaned between uses become direct transfer routes for bacteria like Salmonella and E. coli. The problem appeared at every category of establishment this week, from the oyster bar in Orange City to the Thai bistro in South Daytona.
The cluster of illness-reporting failures is the most acute concern in this week's data. Eight of the twelve facilities were cited for employees not reporting symptoms of illness, and six had no written employee health policy at all. Norovirus, the leading cause of foodborne illness outbreaks in restaurant settings, spreads directly from an infected food worker to a customer through contaminated food. A written policy is the mechanism that keeps a sick employee out of the kitchen. Without one, there is no documented requirement to stay home.
Food from unapproved or unknown sources appeared at four facilities: Sumo, Senorita Mexican Kitchen, Sushi King, and Wild Ginger. When food enters a restaurant through an unapproved channel, it has bypassed the federal inspection systems designed to catch contamination before it reaches a plate. If a customer becomes ill after eating at one of these restaurants, tracing the source of the illness back through the supply chain becomes significantly harder or impossible.
The consumer advisory violation, cited at seven facilities this week, is specifically about protecting vulnerable diners. Pregnant women, the elderly, and people with compromised immune systems face substantially higher risk from raw or undercooked proteins. Without a menu advisory, those customers have no way of knowing a dish contains food that has not been fully cooked. Sushi King, Lan Lamoon, Bagel Barn, Dino's Bar and Grill, Wild Ginger, Nice N Easy, and New Peking all failed this requirement.
The Longer Record
The data provided does not include prior inspection counts for the facilities in this week's report. What the violation profiles themselves reveal is a pattern of foundational failures: absent management, missing illness policies, and unsanitized food contact surfaces are not the kind of violations that appear because a single employee had a bad day. They reflect the absence of systems that take time to build and time to neglect.
The breadth of the week's findings across facility types is notable. Sumo is a sushi and Japanese restaurant. Grille is a casual American bar and grill. Senorita is a Mexican kitchen. Bagel Barn is a cafe and deli. Nice N Easy is an oyster bar. These are not similar operations clustered in one part of the county. They are spread from Edgewater to Deltona to New Smyrna Beach, and they share the same core failures.
Dino's Bar and Grill on Orange Avenue in Daytona Beach carried the week's highest combined violation total, 13 between high-severity and intermediate. That facility was also cited for inadequate shell stock identification records, a violation that matters specifically because shellfish, consumed raw or lightly cooked, carry the highest risk of Vibrio and hepatitis A transmission of any common restaurant protein. Without proper tagging records, there is no way to trace a contaminated batch back to its harvest bed.
Nice N Easy Oyster Bar and Grill was the only facility in Volusia County this week cited for failure to follow parasite destruction procedures. For a restaurant whose menu centers on shellfish and fish served raw or undercooked, that citation stands on its own.
