NOKOMIS, FL. When state inspectors walked into Pop's Sunset Grill at 112 Circuit Road on September 24, they found food coming from unapproved or unknown sources, no written employee health policy, and workers who had not reported illness symptoms, all in a single visit that produced 11 high-severity violations and 3 intermediate ones. The restaurant was not closed.
That total, 14 violations with 11 rated high-severity, represents the worst single inspection in the facility's documented history going back to at least 2023.
What Inspectors Found
The food sourcing violation is among the most serious on the list. Food from unapproved or unknown sources has bypassed USDA and FDA inspection, meaning there is no chain of custody if a customer becomes ill.
Inspectors also cited inadequate shell stock identification records. Pop's Sunset Grill, a waterfront spot, serves seafood. Shellfish such as oysters, clams, and mussels are consumed raw or lightly cooked, and without proper harvest records, there is no way to trace a contaminated batch back to its origin if diners fall sick.
The parasite destruction citation adds another layer. Inspectors found procedures for destroying parasites in fish and pork were not being followed. Without proper freezing or thorough cooking, parasites including Anisakis in fish and Trichinella in pork remain viable and can cause serious illness.
Three violations pointed directly at the people preparing food. No written employee health policy was in place. Workers had not reported illness symptoms. And inspectors found improper handwashing technique, meaning that even when employees washed their hands, they were not doing so in a way that removes pathogens.
No person in charge was present or performing supervisory duties during the inspection. Inspectors also cited improper use of time as a public health control, meaning food was allowed to sit in the temperature danger zone, between 41 and 135 degrees, without the documentation required to make that practice safe. A third intermediate violation involved improper sewage or wastewater disposal.
What These Violations Mean
The combination of no employee health policy and workers not reporting illness symptoms is particularly dangerous. Norovirus, the most common cause of foodborne illness in the United States with roughly 20 million cases annually, spreads directly from infected food workers to customers through contaminated food. A written policy is the first line of defense. Without one, there is no formal mechanism requiring a sick employee to stay home or report symptoms before handling food.
The allergen awareness citation carries a different kind of urgency. Food allergies affect an estimated 32 million Americans, and allergic reactions send roughly 30,000 people to emergency rooms each year. When staff cannot demonstrate allergen awareness, customers with life-threatening allergies to shellfish, tree nuts, or other ingredients have no reliable way to assess their risk before ordering.
The cooling equipment violation compounds the temperature problems. Inadequate cold holding equipment cannot keep food below 41 degrees, the threshold above which bacteria including Salmonella and Listeria multiply rapidly. Combined with the improper time-as-public-health-control citation, the inspection record suggests the facility had no reliable backup system for keeping food safe.
Sewage or wastewater disposal problems introduce a separate contamination pathway entirely. Fecal bacteria in a food preparation environment can contaminate surfaces, equipment, and food directly.
The Longer Record
Pop's Sunset Grill: High-Severity Violations by Inspection
The September 24 inspection was not an aberration. State records show Pop's Sunset Grill has accumulated 281 total violations across 30 inspections on record. Every inspection documented in the prior eight visits going back to April 2023 produced at least four high-severity violations.
The January 2025 and March 2024 inspections each produced seven high-severity violations. The pattern has never resolved. The closest the facility came to a clean inspection in recent history was March 2026, when inspectors cited two high-severity and one intermediate violation. Six months later, the count jumped to 11.
The facility has never been emergency-closed.
After 30 inspections and 281 violations, state records show Pop's Sunset Grill remained open to customers on September 24, 2026.
