FORT MYERS, FL. Saucy Meatball on Commerce Lakes Drive entered the week of September 4 with seven high-severity violations on a single inspection, including improperly stored toxic chemicals, shell stock records that inspectors found inadequate, and no consumer advisory posted for raw or undercooked foods. No person in charge was present or performing duties at the time of inspection.
That last detail matters. When no one is running the kitchen, the violations that follow tend to multiply.
Eight other Fort Myers restaurants drew high-severity citations during the same seven-day stretch, September 4 through September 10, 2026. The nine facilities together accumulated 32 high-severity violations.
The Violations
Las Hermanas Pizzeria 2 on Colonial Boulevard drew six high-severity violations. Inspectors cited food from an unapproved or unknown source, food in poor or adulterated condition, parasite destruction procedures not followed, food contact surfaces not properly cleaned or sanitized, no allergen awareness demonstrated, and no written employee health policy. An intermediate violation for improper sewage or wastewater disposal was also recorded.
That combination is rare and serious. Food from unapproved sources, paired with no parasite destruction, means inspectors could not verify either where the food came from or whether it had been handled to eliminate parasites before service.
Wok Cuisine Chinese Restaurant on Boy Scout Drive received five high-severity citations: no employee health policy, improper handwashing technique, no consumer advisory for raw or undercooked foods, toxic substances improperly identified or stored, and no allergen awareness. Three intermediate violations accompanied those findings, including improperly cleaned multi-use utensils and inadequate ventilation and lighting.
Ceviches by Divino on Dani Drive serves raw fish as a centerpiece of its menu. Inspectors found no consumer advisory posted for raw or undercooked foods, no employee health policy, and food contact surfaces not properly cleaned or sanitized. An intermediate violation for improper sewage or wastewater disposal was also noted.
Tijuana Flats Burrito Co on South Cleveland Avenue drew three high-severity violations: parasite destruction procedures not followed, food contact surfaces not properly cleaned or sanitized, and toxic chemicals improperly stored or labeled. No intermediate violations were cited.
Hibachi Express on Ben C Pratt Six Mile Cypress was cited for an employee not reporting symptoms of illness and improper handwashing technique. Inspectors also documented improper sewage or wastewater disposal and improperly cleaned multi-use utensils as intermediate violations.
Bellacino's Pizza and Grinders, located on the same Ben C Pratt Six Mile Cypress corridor as Hibachi Express, received citations for food contact surfaces not properly cleaned or sanitized and toxic chemicals improperly stored or labeled. An intermediate violation for inadequate ventilation and lighting rounded out the inspection.
Topgolf Ft Myers on Topgolf Way was cited for food contact surfaces not properly cleaned or sanitized and time as a public health control not properly used. An intermediate violation for improper sewage or wastewater disposal was also recorded.
Hardee's on Palm Beach Boulevard drew two high-severity violations: improper handwashing technique and parasite destruction procedures not followed. No intermediate violations were cited.
What These Violations Mean
Food from unapproved sources, cited at Las Hermanas Pizzeria 2, is one of the violations regulators treat most seriously. When food enters a restaurant through an unverified supplier, there is no traceability. If a customer gets sick, investigators cannot identify the source, cannot issue a recall, and cannot stop other customers from being harmed by the same supply. Combined with the parasite destruction failure also cited at Las Hermanas, the concern is specific: fish and certain other proteins require either precise freezing or thorough cooking to kill parasites including Anisakis. If neither the source nor the preparation method can be confirmed, inspectors have no way to verify the food is safe to serve.
The employee illness violations, cited at Saucy Meatball and Hibachi Express, represent a direct transmission risk. A food worker who handles ingredients while sick with Norovirus can contaminate surfaces, utensils, and food itself before any symptoms are obvious to coworkers or managers. The absence of a written employee health policy, cited at Las Hermanas Pizzeria 2, Wok Cuisine, and Ceviches by Divino, removes the structural mechanism that would prompt a sick employee to stay home or report symptoms in the first place.
Improper handwashing technique, cited at Wok Cuisine, Hibachi Express, and Hardee's, is a distinct problem from simply skipping handwashing. An employee who believes they have washed their hands but used incorrect technique, insufficient time, or inadequate soap coverage can transfer pathogens to every surface they touch afterward. Studies show improper technique leaves measurable contamination on hands even after a wash attempt.
The no consumer advisory violations, cited at Saucy Meatball, Wok Cuisine, and Ceviches by Divino, are particularly significant at a ceviche-focused restaurant. Customers who are pregnant, elderly, immunocompromised, or managing certain health conditions face elevated risk from raw or undercooked proteins. Without a posted advisory, those customers cannot make an informed choice.
The Longer Record
Wok Cuisine on Boy Scout Drive has 30 prior inspections on record, the longest history of any facility flagged this week. Five high-severity violations on an inspection at a restaurant that regulators have visited 30 times raises a straightforward question: which of these violations are appearing for the first time, and which have been documented before.
Bellacino's Pizza and Grinders has 28 prior inspections on record. Tijuana Flats Burrito Co has 27. Both drew high-severity violations this week involving toxic chemicals improperly stored or labeled, and both have inspection histories long enough that this week's findings are not attributable to unfamiliarity with state code.
Hardee's on Palm Beach Boulevard has 23 prior inspections on record. Saucy Meatball has 21. The Saucy Meatball citation for inadequate shell stock identification is notable given that shellfish sourcing records are a standard compliance requirement, not a new or ambiguous regulation.
At the other end of the spectrum, Las Hermanas Pizzeria 2 on Colonial Boulevard has only two prior inspections on record. A restaurant that new, accumulating six high-severity violations including unapproved food sourcing and no allergen awareness, is a different category of concern than an established operation with documented history. There is no prior record to suggest whether this week's findings are an anomaly or a pattern.
Ceviches by Divino has 17 prior inspections on record and was still cited this week for no consumer advisory for raw or undercooked foods. A restaurant that specializes in raw fish preparations and has been inspected 17 times without that advisory in place is a fact the record does not explain.
