WEST PALM BEACH, FL. State inspectors cited Don Cafe at 136 N Military Trail for six high-severity violations during the week of October 3, more than any other restaurant in West Palm Beach that week, including a failure to maintain shellfish traceability records, no written employee health policy, and an employee who was not reporting illness symptoms.

That combination, three violations working together, is among the most dangerous configurations an inspector can document. Shellfish served without identification records cannot be traced if a customer gets sick. Workers without a health policy have no formal instruction to stay home when ill. And when no one is reporting symptoms, the policy, even if it existed, would go unenforced.

Don Cafe's inspector also cited improper hand and arm washing technique and food contact surfaces that were not properly cleaned or sanitized. An employee was found reusing single-use items, the one intermediate violation on the report. The person in charge was either absent or not performing duties, the violation that opens the door for every other failure to go unaddressed.

Kung Food at 4645 Gun Club Road collected five high-severity violations during the same week. Inspectors cited the restaurant for the same cluster seen at Don Cafe: no person in charge, an employee not reporting illness symptoms, improper handwashing technique, inadequate shellfish identification records, and food contact surfaces not properly cleaned or sanitized. Multi-use utensils were also cited for not being properly cleaned, an intermediate violation that compounds the surface sanitation problem.

Gun Club Cafe Inc at 4631 Gun Club Road sits less than 200 feet from Kung Food and drew four high-severity violations. The same four violations appeared: no person in charge, no illness reporting, improper handwashing, and inadequate shellfish records. Inspectors added two intermediate citations, one for multi-use utensils and one for single-use items being reused.

Two restaurants on the same block, flagged for the same four high-severity violations in the same week.

Saigon Bar Vietnamese and Japanese Cuisine at 4869 Okeechobee Boulevard also drew four high-severity violations. Inspectors cited no person in charge, no written employee health policy, an employee not reporting illness symptoms, and inadequate shellfish traceability records. The one intermediate violation involved inadequate or improperly maintained toilet facilities, a problem that directly undermines employee handwashing.

Popeyes Fried Chicken at 2825 N Military Trail was cited for two high-severity violations: an employee not reporting illness symptoms and inadequate shellfish identification records. The intermediate violations included improper sewage or wastewater disposal and single-use items being reused. Improper sewage disposal in a food service facility creates a direct pathway for fecal contamination to reach food preparation surfaces.

The two dining venues at 380 Trinity Place were each cited separately. West Palm Beach Canopy drew two high-severity violations: no person in charge and inadequate handwashing facilities. Without functioning handwashing infrastructure, every other handwashing citation at every other facility this week becomes academic. West Palm Beach Canopy Rooftop Restaurant, inspected as a separate operation on the same property, was cited for food contact surfaces not properly cleaned or sanitized and for failing to post a consumer advisory for raw or undercooked foods. Multi-use utensils were also flagged as not properly cleaned.

Duffy's Sports Grill at 6845 Okeechobee Boulevard drew one high-severity violation: no consumer advisory for raw or undercooked foods on the menu.

Hyatt Place West Palm Beach at 295 Lakeview Avenue was cited for two high-severity violations. Inspectors documented improper hand and arm washing technique and food not cooked to the required minimum temperature. Undercooking is one of the most direct pathways to foodborne illness. Salmonella in poultry survives below 165 degrees Fahrenheit, and the violation does not specify what food was involved or how far below temperature it measured.

What These Violations Mean

The shellfish traceability violation appeared at five of the nine facilities this week: Don Cafe, Kung Food, Gun Club Cafe, Saigon Bar, and Popeyes. When shellfish, including oysters, clams, and mussels, arrive at a restaurant without proper identification tags and those tags are not retained, there is no way to trace the source if a customer becomes ill. Shellfish filter large volumes of water and concentrate whatever pathogens are present. A contaminated batch with no records is an outbreak with no starting point.

The employee illness reporting violation appeared at six of the nine facilities. This is not a paperwork problem. Food workers who do not report symptoms of illness, or who work in facilities with no policy requiring them to do so, are the primary driver of multi-victim outbreaks. Norovirus spreads through a single sick food handler touching surfaces or food that dozens of customers will later contact. Don Cafe, Kung Food, Gun Club Cafe, Saigon Bar, Popeyes, and Hyatt Place all had this violation on their reports this week.

The person-in-charge violation, documented at Don Cafe, Kung Food, Gun Club Cafe, Saigon Bar, and West Palm Beach Canopy, is not incidental. CDC data links the absence of active managerial control directly to higher rates of critical violations across all other categories. When no one is running the kitchen with authority, handwashing lapses, temperature shortcuts, and sanitation failures go uncorrected.

At Hyatt Place, the undercooking violation stands apart from the others. Every other high-severity violation this week involved conditions that could lead to illness. An undercooked food violation means the hazard was already in the food when inspectors arrived.

The Longer Record

Don Cafe's 39 prior inspections make it the most-inspected facility on this week's list, and the one with the most high-severity violations. Thirty-nine inspections represent years of regulatory contact. Six high-severity violations in a single week, including no health policy and no illness reporting, is not a facility that has been improving over time.

Kung Food has 34 prior inspections on record. Gun Club Cafe has 30, and Saigon Bar also has 30. All four facilities were cited for the person-in-charge violation this week. Across dozens of inspections, the absence of an accountable manager on duty remains a recurring condition at multiple West Palm Beach locations.

Popeyes on Military Trail has 37 prior inspections, more than any facility except Don Cafe. The sewage disposal violation at a location with that inspection history is not a first-time oversight.

Duffy's Sports Grill has 33 prior inspections and drew one high-severity violation this week. The consumer advisory requirement for raw or undercooked foods is not a new rule. Thirty-three inspections into its regulatory history, the sign is still missing.

The two Canopy venues at 380 Trinity Place are the newest facilities on this week's list, with 18 and 16 prior inspections respectively. The rooftop restaurant's failure to post a consumer advisory for raw or undercooked foods, combined with food contact surfaces not properly cleaned, suggests the property is still establishing basic compliance routines. Hyatt Place, also at 16 inspections, was cited for undercooking, and the inspection record does not identify which food item failed to reach the required temperature.

The Longer Pattern

Seven of the nine facilities cited this week share at least one violation with another facility on the same list. The shellfish traceability failure and the illness reporting failure are not isolated lapses at individual restaurants. They are the dominant findings across West Palm Beach food service this week.

The Gun Club Road corridor is the sharpest example. Kung Food and Gun Club Cafe, two separate operations a short walk apart, each drew the same four high-severity violations. Whether that reflects a shared supplier, a shared labor pool, or coincidence, the inspection record does not say.

What the record does say is that at Hyatt Place, inspectors documented food that did not reach minimum cooking temperature, and the report does not specify what the temperature reading was.
