CLEARWATER, FL. Toxic chemicals were improperly stored or labeled near food at a Clearwater restaurant that state inspectors cited for six high-severity violations in September, and then left open for customers to walk into.
The inspection at La China Poblana Mexican Restaurant and Pizza on North Hercules Avenue took place September 22, 2026. Inspectors documented six high-priority violations and five intermediate violations before leaving the facility in operation.
What Inspectors Found
The chemical storage violation sits at the top of that list for a reason. Chemicals stored near food create a direct contamination pathway, and mislabeled containers mean workers may not recognize the hazard even when it is in front of them.
The restaurant had no written employee health policy, meaning there was no formal system to keep sick workers out of the kitchen. Inspectors also found that food contact surfaces were not properly cleaned or sanitized, and that employees were using improper handwashing technique.
Two additional high-severity violations rounded out the list. The facility was not properly using time as a public health control, a method that requires strict tracking when food is held outside of safe temperature ranges. And the restaurant offered no consumer advisory for raw or undercooked foods, leaving customers with no way to make an informed choice about their risk.
What These Violations Mean
The absence of an employee health policy is not a paperwork problem. It is the mechanism that keeps a worker with Norovirus or Salmonella away from the food being served to customers. Without one, there is no documented standard, no training record, and no accountability when a sick employee shows up for a shift. Norovirus alone accounts for an estimated 20 million illnesses in the United States each year, and a single infected food handler can expose dozens of customers.
Improper handwashing technique compounds that risk. Even when an employee makes an attempt to wash their hands, incorrect technique leaves pathogens on the skin. Combined with food contact surfaces that were not properly cleaned or sanitized, those pathogens have a clear path onto the plates going out to tables.
The time-as-public-health-control violation is particularly significant at a restaurant that appears to offer items that could be served raw or undercooked, given the simultaneous citation for no consumer advisory. When food is allowed to sit in the temperature danger zone, between 41 and 135 degrees Fahrenheit, without proper time tracking, bacterial growth accelerates rapidly. Customers who ordered anything raw or undercooked had no warning on the menu that the item carried added risk.
Improper waste disposal, cited as an intermediate violation, draws rats, mice, cockroaches, and flies. That is not an abstract concern at this address.
The Longer Record
The September 22 inspection was not an anomaly. State records show La China Poblana has been inspected 31 times and has accumulated 303 total violations across that history.
The pattern in recent years is consistent. In April 2025, inspectors cited nine high-severity violations and three intermediate violations in a single visit, the heaviest single-inspection total in the recent record. Two months later, in June 2025, there were four high-severity violations. In May 2026, seven high-severity violations and five intermediate violations. Two months after that, in July 2026, two high-severity violations. The September 2026 inspection, with six high-severity violations, fits squarely into that cycle.
The restaurant was emergency-closed once before, in January 2022, for rodent and fly activity. It was allowed to reopen the same day. The following year, in June 2023, it recorded zero high-severity and zero intermediate violations, the only clean inspection in the recent record. That result has not been repeated.
Open for Business
State inspectors left La China Poblana open after the September 22 visit despite the six high-severity violations, including improperly stored toxic chemicals and no system to keep sick workers out of the kitchen.
The restaurant has now logged high-severity violations in five of its last six documented inspections. It has 303 violations on record across 31 inspections. It was closed once for rodent and fly activity four years ago.
On September 22, 2026, customers could walk in for lunch or dinner without knowing any of that.
