Inspectors who walked into Baguette Nir on Biscayne Boulevard on July 16 found food sourced from unknown or unapproved suppliers, toxic substances improperly stored, and food contact surfaces that had not been properly cleaned or sanitized. They documented six high-severity violations and two intermediate ones. Then they left the restaurant open.

The food sourcing violation is among the most serious in state inspection records. When a restaurant cannot document where its food came from, there is no way to trace it if customers get sick.

The unapproved-source citation means the ingredients in question bypassed USDA and FDA safety inspections entirely. If a contamination event occurs, investigators have no supply chain to follow.

Inspectors also cited toxic substances that were improperly identified, stored, or used. The citation covers any scenario in which cleaning chemicals, pesticides, or other hazardous materials are kept in a way that creates a direct risk of those substances reaching food or surfaces that touch food.

The third high-severity citation, food contact surfaces not properly cleaned or sanitized, compounds the toxic-substance finding. Surfaces that carry chemical residue or bacterial contamination from prior use become a transfer point for every item prepared on them afterward.

Inspectors also flagged that required procedures for specialized processes were not being followed. That category covers operations like smoking, curing, fermenting, or reduced-oxygen packaging, each of which requires precise controls to prevent bacterial growth. Without those controls, the processes that are meant to preserve food can instead accelerate contamination.

Customers were not warned. The missing consumer advisory citation means anyone eating raw or undercooked items at the restaurant had no disclosure that their food carried elevated risk.

What These Violations Mean

The food-from-unapproved-sources violation is not a paperwork problem. Suppliers who operate outside USDA and FDA oversight are not subject to routine testing for Listeria, Salmonella, or E. coli. A customer who gets sick after eating food from an uninspected source has almost no way to know it, and public health investigators have no chain of custody to follow.

The improper handwashing technique citation matters because it means employees were going through the motions of washing their hands without actually removing pathogens. An employee who handles raw product, attempts to wash their hands incorrectly, and then touches a cutting board or a pastry has effectively transferred whatever was on their hands to the food. The food contact surface violation found at Baguette Nir on the same inspection means the surfaces themselves were already compromised.

The toxic substance citation carries its own distinct risk. Improperly stored or unlabeled chemicals near food preparation areas can contaminate food directly, without any visible sign that anything is wrong. A customer would have no way to detect chemical contamination in a finished product.

Taken together, the six high-severity violations documented on July 16 represent failures across multiple independent safety systems, not a single lapse in one area.

The Longer Record

The July 16 inspection was not an outlier. State records show 18 inspections on file for Baguette Nir, with 121 total violations accumulated across those visits.

The pattern of high-severity citations stretches back years. In August 2023, inspectors documented eight high-severity violations and two intermediate ones. In April 2025, the same count, seven high-severity and one intermediate, appeared in a single visit. A follow-up inspection the same day, July 7, 2025, produced another seven high-severity violations. Three months later, in September 2025, inspectors returned and found another high-severity citation. In January 2026, three more high-severity violations were recorded.

The one clean inspection in this record came on December 17, 2024, when inspectors found zero high-severity and zero intermediate violations. That visit stands alone in an otherwise consistent pattern of serious citations.

Baguette Nir has never been emergency-closed. In more than three years of documented inspection history, including multiple visits that each produced seven or eight high-severity violations, the restaurant has remained open after every single inspection.

Still Open

State inspectors have the authority to order an emergency closure when conditions pose an immediate threat to public health. After the July 16 inspection at Baguette Nir, with six high-severity violations including unapproved food sources and improperly stored toxic substances, they did not use it.

The restaurant on Biscayne Boulevard remained open.
