91 The food establishment did not register as a Food Facility with the United States Food and Drug Administration (FDA) prior to beginning of manufacturing/processing, packing or holding food for consumption in the United States. 5K-4.002(D) F.A.C., 21 CFR 1, Subpart H.
The food establishment is not registered with the FDA as a Food Facility. The status shows "cancelled." o 117.20(a) Citation Description: Equipment not properly stored, litter and waste not properly removed, weeds or grass not cut that may constitute an attractant, breeding place or harborage area for pests within the immediate vicinity of the plant buildings or structures. 21 CFR 117.20(a)(1) Observation: Shrubbery overgrown on the west side of the building with branches climbing up the side walls.-- Cut fresh pineapple tops stored in a plastic rack sitting on a table outside of the front door creating an attractant for pests/insects/rodents. o 117.20(b) Citation Description: The plant is not constructed in such a manner as to allow floors, walls, or ceilings to be adequately cleaned and kept clean or to be kept in good repair. 21 CFR 117.20(b)(4) Observation: The wall behind the 3 compartment sink had peeling paint, black mold like residue and holes in the wall. Corrective Action: Owner has some backing on hand to install behind the 3 compartment sink and agreed to repair the wall prior to the next routine inspection. o 117.201(a) Citation Description: Food establishment has not submitted the required qualified facility attestation to the FDA. 21 CFR 117.201(a) Observation: Information on FDA Qualified Facility Attestation provided to the food establishment. o 117.40(f) Citation Description: Instruments and controls used for measuring, regulating, or recording temperatures, pH, acidity, water activity, or other conditions that control or prevent the growth of undesirable microorganisms in food not accurate, precise and adequately maintained, and not adequate in number for their designated uses. 21 CFR 117.40(f) Observation: The 4.0 buffering solution used to calibrate the pH meter showed an expiration date of 09/03/2021. Corrective Action: Owner agreed to purchase a new bottle of buffering solution.---Furthermore, your cold brew coffee which is packaged in kegs that is nitrogen infused that relies on temperature control to prevent the potential growth of C. botulinum toxin formation if the product is temperature abused lacks a temperature monitoring system adequate to prevent the growth of this toxin. Corrective Action: Owner agreed to monitor either by exception or affirmation prior to the . Note: No product for sale of cold brew coffee was in inventory at the time of inspection. o Print Date: 10/5/2023 Page 1 of 3 117.4 Citation Description: Records documenting training of qualified individuals not available. 21 CFR 117.4(d) Observation: Training records for the two employees brewing tea were not available for review and there were deficiencies in the monitoring of pH of the beverages. o 117.80(a)(2) Citation Description: Appropriate quality control operations not employed to ensure that food is suitable for human consumption and food packaging materials are safe and suitable. 21 CFR 117.80(a)(2) Observation: The food establishment uses pH control to prevent the potential for acid-resistant pathogens to grow in your finished kombucha products.
